1. Acceptance of Terms
By accessing or using NovaTrade AI (the "Service"), you agree to be legally bound by these Terms of Service. If you do not agree to any part of these Terms, you must not register an account or use the Service. These Terms form a binding agreement between you and NovaTrade AI.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into binding contracts to use the Service. The Service is not directed to residents of any jurisdiction where the use of automated trading systems is restricted or prohibited by law. It is your responsibility to ensure that your use of the Service complies with the laws applicable to you.
3. Account Registration
You agree to provide accurate, current and complete information during the registration process and to keep that information up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. We may refuse, suspend or terminate any account at our sole discretion, including if we suspect fraud, misuse or a breach of these Terms.
4. Nature of the Service
NovaTrade AI provides automated trading software and informational tools. We are not a broker, dealer, investment adviser or portfolio manager and we do not custody client funds. Funds are held with regulated third-party broker partners pursuant to their own terms. Any trades executed by the AI are placed in the user's brokerage account based on signals generated by our algorithms.
5. No Investment Advice
Nothing on the Service constitutes financial, investment, legal or tax advice. All content is provided for informational and educational purposes only. You alone are responsible for your investment decisions and should consult with a qualified professional before acting on any information provided.
6. Fees
Account creation is free. The AI may charge a performance-based fee on net profits realised in the user's account. All applicable fees are disclosed prior to activation. Broker spreads, commissions, swaps and withdrawal charges are determined by the broker and are not controlled by NovaTrade AI.
7. User Conduct
You agree not to (a) use the Service for any unlawful purpose, (b) attempt to gain unauthorised access to our systems, (c) reverse engineer or copy the algorithms, (d) submit false or misleading information, or (e) interfere with the normal operation of the Service. Violation may result in immediate termination and legal action.
8. Intellectual Property
All software, models, content, trademarks and branding on the Service are owned by NovaTrade AI or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal purposes only.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure or free of viruses.
10. Limitation of Liability
To the maximum extent permitted by law, NovaTrade AI, its affiliates, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, trading losses, loss of data or loss of goodwill, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless NovaTrade AI from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions that by their nature should survive termination shall remain in effect.
13. Changes to the Terms
We may modify these Terms from time to time. The updated version will be posted on this page with a new "last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws applicable to the operating entity of NovaTrade AI, without regard to conflict of laws principles. Any dispute arising under these Terms shall be resolved through binding arbitration or before the competent courts of the operating jurisdiction.
